À quelques jours de la rentrée parlementaire de septembre 2026, la société civile minière entend peser dans le débat sur la révision du Code minier congolais. Réunis samedi 5 septembre à Lubumbashi, les représentants des organisations membres de la plateforme Vision minière durable (VMD) ont analysé le projet actuellement soumis à l’Assemblée nationale et annoncé l’élaboration d’une contre-proposition.

DRC: The Sustainable Mining Vision Platform Is Preparing a Counterproposal to the Revision of the Mining Code

With just a few days to go before the National Assembly reconvenes in September 2026, civil society organizations in the mining sector plan to weigh in on the debate over the revision of the Congolese Mining Code. Meeting on Saturday, September 5, in Lubumbashi, representatives of member organizations of the Sustainable Mining Vision (VMD) platform analyzed the draft bill currently before the National Assembly and announced that they would develop a counterproposal.

Cette réunion technique a été consacrée à l’examen des principales réformes envisagées dans le secteur minier et à la préparation d’une contribution de la société civile au processus législatif.

En ouverture des travaux, Frédéric Malu, coordonnateur national de la VMD, a rappelé la vocation de la plateforme ainsi que ses principaux objectifs, notamment la promotion d’une gouvernance minière durable et davantage centrée sur les intérêts des communautés et de la population congolaise.

Safanto Bulongo, également membre de la plateforme, est revenu sur le contexte dans lequel intervient cette initiative. À l’approche de la rentrée parlementaire de septembre, la révision du Code minier figure parmi les dossiers susceptibles d’être examinés par les députés. La VMD entend dès lors apporter sa contribution aux discussions parlementaires.

Civil Society Wants Its Voice Heard

This technical meeting was devoted to examining the main reforms proposed for the mining sector and preparing a civil society contribution to the legislative process.

At the start of the meeting, Frédéric Malu, national coordinator of the VMD, reiterated the platform’s mission and main objectives, in particular promoting sustainable mining governance that better reflects the interests of local communities and the Congolese people.

Safanto Bulongo, also a member of the platform, discussed the context surrounding this initiative. With the parliamentary session set to resume in September, the revision of the Mining Code is among the issues likely to be considered by lawmakers. The VMD

therefore intends to contribute to the parliamentary discussions.

Un projet de révision jugé insuffisant

Les participants ont procédé à une analyse du projet de révision déjà déposé à l’Assemblée nationale. À l’issue des échanges, plusieurs membres de la plateforme ont estimé que le texte présente des limites et ne répond pas suffisamment, selon eux, aux enjeux actuels du secteur minier congolais.

Pour la VMD, la réforme ne devrait pas se limiter à des ajustements techniques du cadre légal. Elle doit également tenir compte des préoccupations exprimées par les acteurs de terrain et les communautés directement affectées par les activités minières.

C’est dans cette perspective que la plateforme travaille à l’élaboration d’un document alternatif destiné à présenter ses propres propositions de réforme.

A Proposed Revision Deemed Insufficient

The participants analyzed the proposed revision that had already been submitted to the National Assembly. After the discussions, several members of the platform felt that the text had limitations and, in their view, did not adequately address the current challenges facing the Congolese mining sector.

For the VMD, the reform should not be limited to technical adjustments to the legal framework. It must also take into account the concerns expressed by stakeholders on the ground and the communities directly affected by mining activities.

With this in mind, the platform is drafting an alternative document to present its own. proposals for reform.

Un Code minier à adapter au nouveau contexte

Les participants ont également insisté sur l’évolution du contexte minier depuis l’adoption du Code minier de 2018.

Selon les intervenants, la RDC a depuis lors conclu ou adhéré à de nouveaux accords et engagements internationaux susceptibles d’avoir des implications sur la gouvernance des ressources naturelles. La future législation devrait donc, selon eux, intégrer ces nouvelles réalités ainsi que les transformations intervenues dans le secteur.

La VMD souhaite également que la réforme permette de renforcer les retombées économiques et sociales de l’exploitation des ressources naturelles au bénéfice de la population et du développement national.

A Mining Code That Needs to Be Adapted to the New Context

Participants also emphasized how the mining landscape has evolved since the adoption of the 2018 Mining Code.

According to the speakers, the DRC has since concluded or acceded to new international agreements and commitments that could affect natural resource governance. In their view, future legislation should therefore incorporate these new realities as well as the changes that have taken place in the sector.

The VMD also hopes that the reform will help strengthen the economic and social benefits of natural resource exploitation for the population and national development.

Les cahiers des charges au cœur des préoccupations

Parmi les questions soulevées figure celle des cahiers des charges conclus entre les entreprises minières et les communautés locales.

Adrien Mutombo, membre de la VMD, a notamment pointé ce qu’il considère comme l’une des faiblesses du dispositif actuel l’absence de seuils financiers suffisamment précis et contraignants pour encadrer les engagements des entreprises minières en matière de développement local.

Selon lui, le fait de laisser une partie importante de ces engagements à la discrétion des opérateurs miniers peut constituer un frein à la réalisation de projets répondant réellement aux besoins des communautés.

Pour la société civile, la révision du Code minier doit ainsi permettre de renforcer les mécanismes garantissant que les populations vivant dans les zones minières bénéficient effectivement de l’exploitation des ressources de leur territoire.

Terms of Reference at the Center of Concerns

Among the issues raised is the terms of reference agreed upon between mining companies and local communities.

Adrien Mutombo, a member of the VMD, specifically highlighted what he sees as one of the weaknesses of the current system: the lack of sufficiently precise and binding financial thresholds to govern mining companies’ commitments to local development.

In his view, leaving a significant portion of these commitments to the discretion of mining operators can hinder the implementation of projects that truly meet community needs.

For civil society, revising the Mining Code must therefore strengthen the mechanisms that ensure people living in mining areas actually benefit from the exploitation of their territory’s resources.

Une contre-proposition attendue avant les débats parlementaires

À l’issue de cette réunion, les organisations membres de la VMD ont convenu de poursuivre le travail technique afin de finaliser leur document de contre-proposition dans les prochains jours.

Une fois finalisé, ce document devrait être dévoilé et transmis aux députés nationaux appelés à participer aux débats sur la révision du Code minier.

À travers cette démarche, la plateforme Vision minière durable entend contribuer au débat parlementaire en portant les préoccupations des communautés, des acteurs de terrain et de la société civile au moment où la RDC s’apprête à réexaminer son cadre légal minier.

A Counterproposal Expected Before Parliamentary Debates

Following this meeting, the member organizations of VMD agreed to continue their technical work to finalize their counterproposal document in the coming days. Once completed, this document is expected to be released and submitted to the national lawmakers who will participate in debates on the revision of the Mining Code.

Through this initiative, the Sustainable Mining Vision platform aims to contribute to the parliamentary debate by presenting the concerns of communities, on-the-ground stakeholders, and civil society as the DRC prepares to review its legal framework for mining.
